Typology of the legislature and legislative practices

Abstract: This study critically examines the structural configurations of legislative bodies, focusing on the dichotomy between unicameral and bicameral systems, to determine their suitability in fostering democratic governance, representation, and effective law making. The primary objective is to analyze the advantages and disadvantages inherent in each legislative model, considering their application in diverse political and socio-cultural contexts, with particular emphasis on Nigeria. The research adopts a comprehensive qualitative approach, synthesizing existing literature, constitutional provisions, and comparative analyses of various countries’ legislative frameworks. Key materials include scholarly works, legal documents, and case studies of different nations’ legislative systems.
Findings reveal that bicameral legislatures, often characteristic of federal systems like Nigeria and the United States, enhance representational equity by accommodating diverse ethnic, regional, and social interests. They promote thorough scrutiny, broader perspectives, and checks on legislative processes but are associated with higher costs and potential delays due to procedural complexities. Conversely, unicameral systems, prevalent in smaller or homogenous nations, offer cost-efficiency, expedited law making, and greater accountability but might underrepresent minority or regional interests and risk hasty legislation.
The study concludes that the choice between unicameral and bicameral legislatures should align with a nation’s size, diversity, political structure, and developmental objectives. While bicameral systems generally support inclusivity and checks and balances in federations like Nigeria, unicameral legislatures may be more suitable for smaller or homogeneous states. The findings underscore that the effectiveness of a legislative system hinges on its implementation, political will, and contextual appropriateness, rather than structural form alone.
